Regardless of the rule whats hurting u to pay someone if the company is asking you to??? why u so much interested to cut the pay?

as per the new labor law (if u know little bit) its clear that public holidays has to be paid during annual leave also. means if u have 30 calendar days annual leave and 3 public holidays comes in-between u should get extra 3 days leave.

@aa bb- Why don't you read the question before answering. He is asking about payment during unpaid leave, not during paid leave (annual leave). @HR Officer- I think your legal department is right. Since the leave is officially sanctioned, though unpaid, the employee should be compensated for public holidays i.e. public holidays are not considered as leave.

HRO, you are correct. Ask your legal dept to support the claim with particular rule and regulations of the law. Ask them to give you the document. And if they gave you, please publish here the details for others benefit.

In fair spirit, Public Holidays are paid absences in regular salary. I have not come across clear distinct wording in labor law that defines inclusion or exclusion of PH from Unpaid leave.
What does your logic say ? why should PH be not paid during unpaid leave duration !!
