@Judge If you have no time to read then why are you replying. ? He is very desperate and looking for a help. He is crying for his hard earned money and moreover he is sick. Don't be so cruel. you may be also in same situation one day.

No one has gone to the court and am not sure why you are seeking legal help. It is another matter if you are thinking to file a court case. However, you can focus on settlement without going to the court.
1. Look into your agreement and see what has been breached by the builder. Delay is one big breach. 2. Based on breaches, go for tough negotiation with the builder.
Here is what you can do :
Kick the builder out (don’t give anymore time) and three scenarios would emerge. Compensation (Zero, Half and Full). If you can manage zero or half compensation, it is win for you. Else get rid of him by paying full amount and think of building your own.

I had same problem
Please don't make work in partnership, if you don't have money start with small then you can increase. all people are cheating. that builder is cheated you. I feel now he will not complete any work, more over he will not return money to you.
if you have any good family member or good friend can take care of work in india. since you are sick. take care of your health.

Good morning to all,
Thank you Rolly, Krish and all others who attempt to answer of my problems. The reason I am looking for a legal help because in these period I did not find his attitude towards negotiation. If I have that much money than I would not have been did this mistake. Even after my operation no earning since long time. I have no other source to arrange this much big amount. Even I ask other builders who can give him his money and complete the building with same or what ever with new agreement, but no body willing to take without the builders NOC, which he is not giving and saying I am trying to get finance just give me some more time. And now he is not taking the phone at all.So outside negotiation is all most impossible in this attitude.
That so why I am here, thought so many genius are here perhaps I may get some good suggestions which can help to take better action. Also to know whether there is any provision from our embassy for people like us who can not do their legal followups as we are working here. Any how, Thank you all

Even if you go to court, it would take anywhere between 3-10 years for the judgement. Again, one may move to higher court delaying it much further.
The way I understand is, if brick walls are done , it is like 30% construction is done. There is still long way to go. Finishing 4 flats, would require lot of capital. Builder knows the game and being there locally, he has adv over you.
If you can’t pay his invested amount, he would not give you NOC and it is going to be stuck forever. Given severe disadv scenario that you are in, there are not many options. Think whether it is possible to sell the entire land with unfinished construction? If the buyer is powerful, builder can’t do much and this way you would have satisfaction of teaching lesson to builder. Offer an attractive deal to have many buyers.
Other option is moving to court which is a long drawn battle.
